“Services” means the physiotherapy and other allied-health services provided by Quantum Performance. 

Collecting your personal information

When you engage (or seek to engage) Quantum Performance to provide services to you, we will ask for your name, date of birth, address and contact details. We may also ask you to provide health information including your medical history, results of medical tests, health concerns and details of your health care professionals.

We generally collect your personal information in person, in writing (for example, when you complete our New Patient Form), via our website or other online technologies, or by telephone, email or video conference call over the internet.

We may also, with your consent, collect information from third parties such as your medical practitioner or mental health professional.

You can choose not to provide us with the personal information we request, however this may result in us not being able to provide you with the services you require. 

Information collected through our website

We may also record information from you when you submit an inquiry or contact us through our website, or automatically as you navigate our website. The type of information recorded may include the date and time you visit our site, the pages you access, any information you download and any details you enter. We may use information collected via our website for statistical and reporting purposes and to administer and maintain our website.

We may use cookies on our website to enhance your user experience. Cookies are small files that websites or applications may transfer to your computer or device that are used to recognise repeat users and remember user preferences. Cookies can also be used to gain statistics regarding which areas of our website are most visited. We aim to ensure that the personal information we hold about you is accurate, complete and up to date. If there are any changes to your personal information, please inform us so that we can update our records.

You can also access, on request, the personal information we hold about you (unless access may be denied under the Privacy Act or other laws). If upon accessing your personal information you believe that any of the information is incorrect, please let us know so that we can correct any errors.

Your personal information will be stored electronically and/or in hard copy form. For electronic data storage, we may use products and services that rely on public cloud systems managed by third party service providers (such as Microsoft Azure and Amazon Web Services). You acknowledge that, having regard to the nature of cloud-computing, your information may be replicated to locations other than the physical location of a service provider, and that your information may be stored or accessed outside Australia.

We will endeavour to use only reputable service providers who agree to comply with Australian privacy principles and guidelines, or are subject to similar privacy standards in other jurisdictions. We will also endeavour to comply with all security measures and protocols implemented by our service providers. However, we are not responsible for any privacy or data security breach by or affecting our service provider.

We will take measures to destroy and de-identify personal information that is no longer required for the services or any lawful purpose (subject to any legal requirements imposed on us, for instance, in relation to record-keeping).

We also process payments using HICAPS, EFTPOS and online technologies. All transactions processed by us meet industry security standards to ensure payment details are protected.

If our website contains links to third party websites, you should be aware that the linked sites are not under our control and we are not responsible for the privacy or security practices of those websites. Any access to, or information you provide on, third party websites is at your own risk and we do not accept responsibility or liability that may arise from you accessing any linked website.

Artificial intelligence (AI) and automated decision-making tools

We may use AI and other automated tools for our functions or activities, including to help gather, sort and summarise data, to help improve our services, and to manage our business efficiently.

For example, these tools may be used to:

• legal, accounting, insurance, audit and other professional services
• collect, sort and collate your personal information
• record patient consultations to generate treatment notes for our internal patient records
• review, summarise or consolidate patient records
• generate letters and other communications, such as referral letters, treatment advice for other practitioners involved in your healthcare, and appointment scheduling or reminders; and
• assist in other business functions, such as screening and scoring applicants as part of any recruitment process.

These tools may use personal information that you provide when reasonably necessary to perform our functions and activities. The data generated by the AI tool may also contain reproductions of such information and Quantum Performance will take reasonable measures to ensure the accuracy of such information, including by human oversight and review of generated works.

Information that is input into some AI tools and the data generated by some AI tools may be used to train and develop the technology. Our software providers and AI tools are carefully selected, prioritising industry-specific products and services that are designed to be compliant with Australian privacy laws and which do not permit the use of personal information for training general-purpose artificial intelligence models. Quantum Performance will not authorise the use of your personal information (other than on a de-identified basis) for AI training purposes, without your prior consent. However, we are not responsible for any privacy or contract breach by our software providers.

Decisions about your healthcare and treatment, and the services we provide to you, are very important. These decisions will not be made by an AI tool.

We may use an AI tool to make automated decisions for other business or administrative functions (such as recruitment activities), based on personal information we have collected from you or information obtained from other sources. We acknowledge that automated decisions by an AI tool may have a significant impact on how we engage with you, and you have the right to request human review of any automated decision, including by providing additional information or contesting the automated decision.

We will review this Privacy Policy from time to time to take into account new laws and technology and to ensure that it remains appropriate to the changing environment. We will publish revised versions on our website as set out above and any information we hold will be governed by our most up to date version of the Privacy Policy.
